    • Check in 4:00 PM, check out 10:00 AM, quiet hours 10:00 PM to 8:00 AM (Section 5).

    • Violation fees from $50 to $500, listed in one table (Section 5.11).
    • Guests carry responsibility for damage, with a $50 coordination fee added to replacement cost (Section 6.1).
    • Texas law, binding arbitration in Harris County, small claims carve out (Section 10).

    1. About these Terms

1.1 Who we are. HTX Pads is a brand name used for short term rental homes in the Houston, Texas area. Each home is operated by the legal entity named in your reservation confirmation (the “Operator”, “we”, “us”). “You” means any person who visits this website, requests a quote, makes a reservation, or stays at a property.

1.2 Properties covered. These Terms apply to this website and to every home we list on it, now or in the future. They set general rules only. Your listing, house manual and reservation confirmation may add practical details for a specific home, such as parking and check in instructions. If those details conflict with these Terms on safety or occupancy, the stricter rule controls.

1.3 Where you book. You may book through this website or through a third party platform such as Airbnb or VRBO. If you book through a platform, that platform’s terms also apply to payment, cancellation and refunds. If the two conflict, the platform’s terms control for those topics and these Terms control for everything about your stay and conduct.

1.4 Acceptance. By using this website, requesting a reservation, checking in, or staying at a property, you agree to these Terms. If you do not agree, do not use the website or book a stay.

1.5 Changes. We may update these Terms. The version posted on the website when you book applies to your stay. Updates do not change a confirmed reservation unless required by law.

    2. Website use and intellectual property

2.1 Permitted use. You may use this website to browse our homes, check availability, request quotes and make reservations for lawful personal purposes. You may not scrape the site, use bots to book or monitor availability, interfere with its operation, attempt to access systems you are not authorized to use, or submit false information.

2.2 Accuracy of listings. We work to keep descriptions, photos, rates and availability accurate. Homes are real properties, so small differences in furnishings, decor, landscaping and amenities can occur. Amenities such as pools, heaters, appliances and internet can be temporarily unavailable for maintenance or repair, and that is not a breach of these Terms.

2.3 Accounts. If you create an account, you are responsible for keeping your login secure and for all activity under it. Tell us right away if you suspect unauthorized use.

2.4 Intellectual property. All website content, including text, photos, floor plans, logos, the HTX Pads name and design, belongs to us or our licensors. You may not copy, reproduce, republish or use it commercially without written permission. You may share links to the site and post your own stay photos on personal social media.

2.5 Third party links. The site may link to other websites, maps, vendors or booking platforms. We do not control them and are not responsible for their content or practices.

2.6 Availability of the site. We may modify, suspend or discontinue any part of the website at any time without notice.

    3. Reservations, rates, taxes and payment

3.1 Eligibility. The primary guest must be at least 25 years old, must stay at the property for the entire reservation, and is responsible for every person in the group. We may cancel a reservation without refund if the primary guest does not meet this requirement.

3.2 Booking is a contract. A reservation is confirmed when you receive a confirmation from us or the booking platform. By booking, you confirm that the information you gave is accurate and that you have authority to accept these Terms for everyone in your party.

3.3 Rates and fees. The total shown at checkout includes the nightly rate, cleaning fee, any extra guest or pet fees, and applicable taxes. Rates vary by date, length of stay and demand. We may use dynamic pricing, so rates for the same dates can change before you book. Once confirmed, your rate does not change.

3.4 Taxes. You agree to pay all applicable state and local occupancy taxes. Where a booking platform collects and remits taxes, the platform’s total controls. Where we collect them directly, they appear as a separate line item.

3.5 Payment. Direct bookings are charged to the card you provide, either in full or on a deposit and balance schedule shown at checkout. A failed payment may result in cancellation of the reservation and release of the dates.

3.6 Chargebacks. Disputing a valid charge with your card issuer without first contacting us breaches these Terms. We will provide the issuer with your signed agreement, ID verification, messages, check in records and photos to contest the dispute, and you remain liable for the amount owed plus our reasonable costs.

    4. Cancellations, changes and refunds

4.1 Direct bookings. Our cancellation policy is Moderate, the same as Airbnb’s Moderate policy for stays under 28 nights. Deadlines use the home’s local time zone.

    When you cancelWhat you receive
Within 24 hours of booking, if you booked 7 or more days before check inFull refund
Up to 5 days before check inFull refund of the price we set, including taxes
Less than 5 days before check inTaxes refunded. We keep one additional night plus 50% of all unspent nights, and you receive the rest
After check inTaxes for unused nights refunded. We keep every night stayed, one additional night, and 50% of all unspent nights

4.2 Platform bookings. Bookings made through Airbnb follow Airbnb’s Moderate policy as shown on the listing. Bookings made through VRBO or another platform follow the cancellation policy shown on that listing at the time of booking.

4.3 Changes. Date changes depend on availability and may change the rate. Request them in writing as early as possible. Shortening a stay after check in does not entitle you to a refund.

4.4 Early departure or removal. If we end your stay for a violation of these Terms, no refund is due.

4.5 Our cancellations. If we must cancel for reasons within our control, such as a double booking or a major maintenance failure, we will refund you in full and try to help you find comparable lodging. That is our only responsibility in that case.

4.6 Events outside our control. Hurricanes, floods, freezes, power or utility outages, government orders, and similar events are outside our control. If an official evacuation or closure order covers the property’s area during your stay, we will work with you in good faith on a credit or partial refund. We do not guarantee refunds for weather forecasts alone. We strongly recommend travel insurance.

4.7 Service interruptions. Temporary loss of internet, hot water, air conditioning, cable, pool heating or similar amenities does not by itself entitle you to a refund. Tell us right away so we can try to fix it.

    5. Check in, occupancy and house rules

5.1 Check in and out. Standard check in is 4:00 PM and standard check out is 10:00 AM local time, unless your listing or confirmation says otherwise. Early check in and late check out require at least 24 hours’ notice and are only available if we confirm them in writing. Fees cover the adjusted cleaning shift. Early check in is $75 to $100 for one hour early, $150 to $200 for two hours early, and a full nightly rate for three or more hours early. Late check out is $100 for one hour, $200 for two hours, and a full nightly rate for three or more hours. Any guest or belongings remaining past check out without written approval are charged $50 for every 15 minutes, with any partial 15 minutes billed in full.

5.2 Identity verification. We may require government ID, a signed rental agreement and other verification before you receive access instructions. We may cancel without refund if verification is not completed.

5.3 Maximum occupancy. The maximum number of guests is stated on each listing. This includes children and infants who stay overnight. Day visitors must be approved in advance, are limited to the number we allow, and must leave by 10:00 PM. Extra overnight guests or visitors are charged $50 per person per night. Exceeding occupancy limits may result in additional fees, immediate removal without refund, or both.

5.4 No parties or events. Parties, events, gatherings, commercial photo or film shoots, and any activity that draws more people than the registered guests are not allowed. Breaking this rule is a material breach and may result in a fee starting at $500 plus cleaning and damage costs, immediate removal without refund, and responsibility for all resulting costs.

5.5 Quiet hours and neighbors. Quiet hours are 10:00 PM to 8:00 AM, unless your listing says otherwise or local ordinance requires longer. Pools and hot tubs are closed during quiet hours, and outdoor music and loud noise are not allowed. Some homes use noise level sensors that measure volume only and do not record conversations. Repeated complaints may end your stay.

5.6 Smoking and drugs. Smoking and vaping of any substance are not allowed inside any property. A $250 fee applies for extra cleaning and odor removal. Illegal activity of any kind is prohibited and will be reported.

5.7 Pets. Pets are only allowed where the listing says so. Where allowed, approved dogs are welcome for a $75 fee per stay, and cats are not allowed. Pets are never allowed in the pool or hot tub, and you must clean up after them. Unapproved pets are charged $150 per pet plus any cleaning or damage costs, and may result in removal. Service animals are welcome as required by law.

5.8 Parking. Park only in designated spots. Do not block neighbors, driveways or fire lanes. Vehicles may be towed at the owner’s expense.

5.9 Prohibited items. No weapons discharge, fireworks, open flames indoors, grills inside or on covered patios, or hazardous materials. Do not remove property from the home.

5.10 Subletting. You may not sublet, resell or transfer your reservation.

5.11 Fees for rule violations. These fees apply only after a clear violation. They are charged through the booking platform’s resolution process or to the card on file. Most guests never pay them.

    6. Safety, damage, cameras and amenities

6.1 Responsibility for damage. You are responsible for all damage, loss, excessive cleaning, missing items and extra service costs caused by you, your guests or your invitees during your stay, beyond normal wear and tear. Damage is charged at the item’s replacement cost plus a $50 coordination fee. We may charge the card on file or the platform resolution process for documented costs. We will provide photos, receipts or estimates on request.

6.2 Reporting. Report any damage, injury, safety issue or malfunction as soon as it happens. Do not attempt repairs on appliances, pool equipment, electrical or plumbing systems.

6.3 Smart locks and access codes. Properties use keyless entry. Codes are unique to your stay and active only for your reservation dates. Do not share them or prop doors open. Lockouts, lost keys and lost fobs carry the fees listed in Section 5.11.

6.4 Security cameras and monitoring. Exterior cameras may be used at entrances, driveways and yards for security and to confirm occupancy. We never place cameras inside bedrooms, bathrooms or living areas. Noise and occupancy monitors may measure sound levels and device counts, without recording conversations. Details for each home are listed in its listing. Tampering with, covering or disabling any device is a violation of these Terms.

6.5 Pools, hot tubs and water features. Where a home has a pool or hot tub, you use it at your own risk. There is no lifeguard. Every user must sign the pool waiver before use, and use without it is charged as shown in Section 5.11. Guests under 14 must be supervised by an adult at all times. Keep safety fences and gates latched when the pool is not in use. Use the plastic cups provided instead of glass on the pool deck. Pets are not allowed in the pool. Do not dive, run, or swim when alcohol or drugs impair you. Lights and equipment may shut off automatically at night, and heaters may be shut off for safety or repair. Do not touch, adjust or tamper with pool equipment or chemicals.

6.6 Smoke and carbon monoxide detectors. Detectors are installed for your safety. Do not disable or remove them. Fire extinguishers and first aid kits are located as shown in the home guide.

6.7 Emergencies. In an emergency, call 911 first, then contact us. We are not emergency responders.

6.8 Neighborhood and local conditions. Houston and surrounding areas have urban and suburban risks, including traffic, flooding, severe weather, wildlife and insects. You are responsible for your own awareness, safety and belongings. We recommend locking doors, closing windows and securing valuables.

    7. Guest responsibilities, issues during your stay and reviews

7.1 Leave it as you found it. Please follow the checkout instructions in your home guide, which typically include loading the dishwasher, taking trash to the outside bins, closing windows and doors, turning off lights and setting thermostats as listed.

7.2 Tell us fast. If something is wrong, contact us as soon as you notice it so we can help. Issues reported only after checkout may not qualify for compensation.

7.3 Right of entry. We, our cleaners and our contractors may enter the property only for emergencies, urgent repairs, safety checks, or to enforce these Terms, with notice when practical.

7.4 Removal for violations. If you or your guests violate these Terms, we may end your stay immediately, require everyone to leave, and keep all amounts paid. You remain responsible for any damage and costs.

7.5 Lost items. We are not responsible for items left behind. We will try to return any items we find to you. Return shipping is at your expense.

7.6 Reviews. We welcome honest reviews. Reviews may not include threats, private information, or statements you know are false, and may not be offered in exchange for payment, refunds or other concessions beyond what you would be owed under these Terms. We may respond publicly to reviews.

7.7 Local laws. You agree to follow all federal, state and local laws and ordinances, including those about noise, parking, occupancy, firearms, alcohol, drugs and short term rentals.

    8. Disclaimers, limitation of liability and indemnification

8.1 Use at your own risk. The website and properties are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, uninterrupted service, and that the website is free of errors or viruses.

8.2 Limitation of liability. To the fullest extent allowed by law, our total liability to you for any claim arising from your use of the website or your stay will not exceed the amount you paid for the reservation. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost wages, lost travel costs, or loss of enjoyment. Nothing in these Terms limits liability that cannot be limited by Texas law, such as liability for our own gross negligence or willful misconduct where the law does not permit a waiver.

8.3 Personal property. We are not responsible for loss, theft or damage to your belongings, vehicles or valuables, whether in the home, in the yard or on the street.

8.4 Assumption of risk. You acknowledge that activities at a rental property, including swimming, using stairs, patios and outdoor areas, cooking, and using equipment, carry risks. You assume those risks for yourself and your party.

8.5 Indemnification. You agree to defend, indemnify and hold harmless the Operator, its owners, members, managers, employees, cleaners, contractors and agents from claims, losses, fines, penalties, and reasonable attorney fees arising from your or your guests’ breach of these Terms, violation of law, injuries to others, or damage to property.

8.6 Third party services. Cleaners, pool technicians and other vendors act as independent contractors. We are not responsible for the acts of other platforms, payment processors, utility providers or other third parties.

    9. Privacy, communications and SMS consent

9.1 Information we collect. We collect the details you give us (name, contact information, ID verification, payment details, guest count, messages) and basic technical data such as IP address, device type and pages viewed through cookies and analytics tools.

9.2 How we use it. We use it to process bookings, verify identity, communicate about your stay, provide access codes, prevent fraud and damage, resolve disputes, improve the website, and meet legal obligations.

9.3 Sharing. We share information with service providers that help us operate, such as payment processors, booking and messaging platforms, smart lock providers, cleaners and maintenance vendors, and with authorities when required by law. We do not sell your personal information.

9.4 Payment data. Card numbers are handled by our payment processors. We do not store full card numbers on our own systems.

9.5 Cookies. The website may use cookies and similar tools for performance, analytics and advertising. You can control cookies in your browser settings.

9.6 Security and retention. We use reasonable safeguards but no system is completely secure. We keep records as long as needed for business and legal reasons, then delete or anonymize them.

9.7 Calls, texts and email. By providing your phone number and booking, you agree we may contact you by phone, text and email about your reservation, access, check in, checkout, safety and service issues. Message and data rates may apply. Reply STOP to opt out of non essential texts, but we may still need to contact you about an active stay. Separate marketing messages are sent only with your consent.

9.8 Your choices. You may ask us to access, correct or delete your personal information through the contact form on this website or the messaging system of your booking. We may need to keep some records for legal, tax, safety or dispute reasons. A separate Privacy Policy, if posted, supplements this section.

9.9 Children. The website is not directed to children under 13, and we do not knowingly collect their information.

    10. Governing law, disputes and general terms

10.1 Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.

10.2 Contact first. Before filing any claim, you agree to send us written notice describing the problem and give us 30 days to resolve it.

10.3 Binding arbitration. Except for the carve outs below, any dispute arising from these Terms, the website or your stay will be resolved by final and binding arbitration administered by the American Arbitration Association under its consumer rules, in Harris County, Texas, before a single arbitrator. Judgment on the award may be entered in any court with jurisdiction.

10.4 Carve outs. Either side may bring an individual claim in small claims court, and either side may seek emergency injunctive relief in court to stop imminent harm, such as unsafe conduct at a property or misuse of our intellectual property.

10.5 No class actions. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative action.

10.6 Venue and jury waiver. For any claim that proceeds in court, the state and federal courts located in Harris County, Texas have exclusive jurisdiction, and each side waives the right to a jury trial to the extent the law allows.

10.7 Attorney fees. The prevailing party in any dispute may recover reasonable attorney fees and costs where the law allows.

10.8 Severability and waiver. If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a provision once does not waive it later.

10.9 Entire agreement and assignment. These Terms, your reservation confirmation and any signed rental agreement are the entire agreement between you and us. We may assign them to a successor or affiliate. You may not assign them.

10.10 Notices. We may send notices to the email or phone number you gave us. You may contact us through the contact form on this website or the messaging system of your booking platform. Send formal notices the same way.

10.11 Accessibility. If you need an accommodation to use the website or a property, contact us and we will work with you in good faith.
